On Monday, Judge Scott McAfee expressed concern over Fulton County District Attorney Fani Willis potentially being disqualified from Trump’s RICO case due to her inappropriate connection with top Trump prosecutor Nathan Wade.
Additionally, the judge emphasized the necessity of Thursday’s evidentiary hearing regarding alleged misconduct.
“I think it’s clear that disqualification can occur if evidence is produced demonstrating an actual conflict or the appearance of one,” Judge McAfee said in Monday’s hearing. “The state has admitted a relationship existed. And so what remains to be proven is the existence and extent of any financial benefit, again if there even was one. And so because I think its possible that the facts alleged by the defendant could result in disqualification, I think an evidentiary hearing must occur to establish the record on those core allegations.”
“I think the issues at point here are whether a relationship existed, whether that relationship was romantic or non-romantic in nature, when it formed, and whether it continues. And that’s only relevant because it’s in combination with the question of the existence and extent of any personal benefit conveyed as a result of their relationship,” the judge said.

According to a recent lawsuit filed by Michael Roman, Trump’s RICO co-defendant, Fani Willis and Nathan Wade have been subpoenaed to testify at an evidentiary hearing scheduled for Thursday.
Ashleigh Merchant, the attorney representing Michael Roman, has accused Fani Willis’ office of intentionally withholding information in the same lawsuit.
These subpoenas could potentially lead to both Willis and Wade giving sworn testimony during a televised hearing on February 15th.
This is in response to a motion filed by Michael Roman seeking the dismissal of the RICO charge as well as the disqualification of Willis due to her romantic relationship with Wade.
Judge McAfee has indicated that he will likely allow testimony from at least one witness subpoenaed in Roman’s lawsuit, but will make a decision about calling Fani Willis after further progress is made in the hearing.
“I don’t see how I can make that determination on the front end without live testimony subject to cross-examination,” Judge McAfee said. “With each one of these witnesses, I would defer the ruling until we get further into the hearing itself.”
“We’re not talking about calling Ms. Willis as the first witness, and we need to get over a few procedural hurdles before we can get there,” the judge added.
In an explosive supplemental reply, Michael Roman, who is a co-defendant of Trump in the RICO case, accused Fulton County District Attorney Fani Willis of lying to the court about her affair with Nathan Wade, a top Trump prosecutor she appointed.
The Atlanta Journal-Constitution reported that Fani Willis allegedly financially benefited from her romantic relationship with Nathan Wade. The Superior Court of Fulton County had previously received a motion on behalf of Michael Roman, who is facing seven counts in Fani Willis’ RICO case.
The filing alleges that Nathan Wade, the special prosecutor assigned to investigate Trump, funded luxurious vacations for himself and Fani Willis to destinations like Napa Valley and the Caribbean.
It further claims that money from Fulton County was used to finance these out-of-town escapades.
“County records show that Wade, who has played a prominent role in the election interference case, has been paid nearly $654,000 in legal fees since January 2022. The DA authorizes his compensation.” the Atlanta Journal-Constitution reported.
Earlier this month, Fani Willis disclosed that she is engaged in a sexual relationship with Nathan Wade, the lead prosecutor appointed by her for Trump’s RICO case.
In a comprehensive court filing spanning 176 pages, Willis openly acknowledged her inappropriate involvement with her romantic partner. This came as a response to allegations of misconduct made by Michael Roman, one of Trump’s co-defendants.
Willis countered Roman and Trump’s attempts to disqualify her from the case by asserting that they failed to demonstrate any conflict of interest.
“Defendants have done nothing to establish an actual conflict of interest, nor have they shown that, in the handling of the case, District Attorney Willis or Special Prosecutor Wade have acted out of any personal or financial motivation,” the filing said.
Nathan Wade confessed to engaging in a sexual relationship with Fani Willis, but he claimed that their relationship did not begin until 2022 – long after she had hired him as the top prosecutor in 2021.
“In 2022, District Attorney Willis and I developed a personal relationship in addition to our professional association and friendship,” Nathan Wade said.
It also turns out Fani Willis and Nathan Wade are lying about when their illicit affair began.
According to the 122-page filing, a Georgia attorney who is friends with Nathan Wade will refute the claim that their affair began in 2022 after Willis appointed Wade in 2021.
“Willis and Wade claim they did not have a personal, romantic relationship before Willis appointed Wade as a special prosecutor, but Terrence Bradley (“Bradley”) will refute that claim. Bradley is an attorney and a member of the Georgia Bar. Bradley and Wade were friends and business associates. Bradley has non-privileged, personal knowledge that the romantic relationship between Wade and Willis began prior to Willis being sworn as the district attorney for Fulton County, Georgia in January 2021. Thus, Bradley can confirm that Willis contracted with Wade after Wade and Willis began a romantic relationship, thus rebutting Wade’s claim in his affidavit that they did not start dating until 2022,” Michael Roman’s lawyer wrote in the filing.
Robin Yeartie, an employee of the Fulton County DA’s office, is set to provide testimony stating that Fani Willis and Nathan Wade falsely claimed to be living together.
“Bradley also has personal knowledge that Wade and Willis regularly stayed together at her home until Willis’ father moved into her home sometime in 2020,” Roman said in the filing.
He continued, “Bradley will confirm that Willis and Wade stayed together at this apartment until Yeartie’s employment was terminated in the Fall of 2022, at which time Willis and wade began staying in what was known commonly as a “safehouse” that Fulton County, Georgia rented for Willis. Willis and Wade stayed together at both residences regularly.”
In a recent development, Jocelyn Wade, the estranged wife of Nathan Wade, has responded to Fani Willis’ request for a protective order. To support her claims, she has presented concrete evidence.
According to the bank statements submitted by Jocelyn Wade, it is evident that Nathan Wade spent a significant amount of money on Fani Willis. His expenses included purchasing flowers for her, covering hotel charges, air travel costs, funding a cruise trip, and even paying for Ubers.
The provided bank statements serve as proof that Nathan Wade not only bought flight tickets for Fani Willis but also covered her travels to Miami and San Francisco.
