Committee Republicans asked the Department of Justice to open a formal inquiry into a string of executive actions that may not be traceable to the president’s consent. They also requested that the D.C. Board of Medicine examine the role of Dr. Kevin O’Connor after he repeatedly declined to answer questions about his conduct. The report frames these refusals as deeply troubling given the physician’s duty to the office and the nation.
“His refusal to answer questions about the execution of his duties as physician to the president — combined with testimony indicating that Dr. O’Connor may have succumbed to political pressure from the inner circle, influencing his medical decisions and aiding in the cover-up — legitimizes the public’s concerns that Dr. O’Connor was not forthright in carrying out his ultimate duties to the country.”
According to the committee, senior advisers shaped how Biden appeared and functioned in public, even organizing the use of teleprompters for small events and consulting outside influencers on high-profile addresses. The report paints a picture of an inner circle that prioritized optics and political calculations over transparency about the president’s capabilities. Republicans argue that voters have a right to know whether consequential decisions truly came from the commander in chief.
The autopen controversy sits at the center of the report’s legal claims, with Chair James Comer calling it “one of the biggest political scandals in U.S. history.” Committee Republicans contend that some documents bearing the president’s signature were produced without an approval traceable to him, and they question whether certain pardons and executive actions should stand. If true, the implications reach directly into the constitutional authority to execute the powers of the presidency.
Testimony transcribed by investigators undercuts claims of full accountability inside the West Wing, the report says, and even former senior officials could not or would not identify who controlled the autopen. Asked directly whether he even knew who operated the autopen, former White House chief of staff Jeff Zients — who approved 11th-hour pardons for first family members on Jan. 19, 2025 — answered bluntly in an transcribed interview with the committee: “I do not.”
The report also addresses involvement by family in clemency discussions, noting testimony that Hunter Biden participated in end-of-term conversations about pardons. “The authority to grant pardons is not provided to the president’s inner circle. Nor can it be delegated to particular staff when a president’s competency is in question,” the report notes. “Importantly, even if this authority could be delegated — which it cannot — it would have to be expressly delegated by President Biden himself.”
Republican witnesses described plans to evaluate the president after a poor debate performance, including discussions about cognitive testing that advisers ultimately rejected for political reasons. Anita Dunn’s testimony that advisers feared tests would not quiet critics is cited as proof the team prioritized optics over transparency. Committee members say that reluctance to document or test the president’s cognitive capacity is itself part of a broader cover-up.
Dr. O’Connor’s invocation of the Fifth Amendment when asked if he had been told to lie or thought the president unfit added fuel to investigators’ concerns, Republicans say. Counsel for the doctor cited confidentiality and privilege, but the report argues the special nature of presidential medicine creates an obligation that transcends routine patient privacy issues. The committee urges the relevant medical board to examine whether those professional duties were fulfilled.
The report concludes with a demand that federal prosecutors and medical regulators pursue these leads aggressively to restore confidence in executive governance.
