Trump Issues Executive Order Mandating Citizenship Proof for Voting

President Donald Trump took decisive action by signing an executive order aimed at bolstering the integrity of federal elections. The order mandates that states require government-issued proof of U.S. citizenship for voter registration. Additionally, it ties federal funding to states’ implementation of voter ID requirements.

“This Executive Order is the farthest-reaching executive action taken in the history of the republic to secure our elections,” Trump announced on Truth Social. He emphasized the importance of “free, fair, and honest elections unmarred by fraud” as crucial to sustaining the constitutional Republic. The President underscored the necessity for votes to be accurately counted without illegal dilution.

Under the Constitution, Trump noted that state governments are responsible for safeguarding elections in line with federal laws. These laws are designed to protect voting rights and prevent illegal voting and other forms of election malfeasance. The President highlighted that elections must inspire public trust through reliable voting methods.

To ensure this trust, Trump called for voting methods that produce voter-verifiable paper records. He stressed the importance of voters being able to verify their votes as a safeguard against fraud or mistakes. The President declared that election integrity standards must be updated to reflect these priorities.

Currently, voters in federal elections only need to verbally affirm their citizenship. Trump’s executive order aims to resolve the long-standing debate over requiring documentation of U.S. citizenship. Previously, the Safeguard American Voter Eligibility (SAVE) Act passed the House but failed in the Senate.

Some states, like Alabama and Arizona, have already introduced measures requiring proof of citizenship. However, the Supreme Court’s 2006 ruling in Purcell v. Gonzalez advised against changing election rules close to elections. This ruling was intended to avoid voter confusion and election disruption.

Lower federal courts have historically challenged attempts to impose citizenship requirements before elections. In 2014 and 2016, courts ruled against a U.S. Election Assistance Commission official for allowing certain states to require proof of citizenship. More recently, the 9th Circuit Court of Appeals deemed some of Arizona’s voting laws “unlawful.”

Arizona’s continued efforts to expand citizenship requirements were struck down again this year by the 9th Circuit Court. Trump’s executive order seeks to enforce stricter voter ID measures across states. Currently, 15 states do not require government-issued IDs for voting, while 12 require IDs without photos.

The executive order also tasks the U.S. Attorney General and Treasury Secretary with enforcing laws against foreign contributions to U.S. elections. These measures aim to prevent foreign nationals from influencing American elections. Moreover, the order classifies election infrastructure as “critical” to prevent non-citizens from managing it.

The Attorney General and Secretary of Homeland Security are mandated to protect voting machines, ballots, and election equipment. This step underscores the administration’s commitment to maintaining secure and trustworthy election processes. By labeling these components as critical infrastructure, the order seeks to enhance oversight and security.

Trump’s action reflects a broader conservative push for election integrity. Supporters argue that requiring proof of citizenship is a common-sense measure. They believe it strengthens the democratic process and ensures that only eligible citizens participate in elections.
