Alina Habba, the legal representative of former President Donald Trump, expressed concerns about the fairness of his trial in the hush money case due to perceived political bias among the jury.

In an interview on Fox News, Habba raised apprehensions about potential bias from what she referred to as “politicized judges and blue juries” that could work against Trump.

Although not involved in Trump’s falsifying business records trial in New York, Habba shared worries about the impartiality of the proceedings.

Judge Juan Merchan, presiding over the hush money trial, imposed a $9,000 fine on Trump for violating a gag order prohibiting discussion of potential witnesses in public and warned of potential jail time.

Trump, a probable candidate for the Republican presidential nomination in 2024, has repeatedly claimed that Judge Merchan exhibits bias against him.

He sought to relocate the trial from Manhattan, known for its Democratic leanings, to Staten Island with a predominantly Republican base in hopes of securing a more neutral jury.

Habba emphasized on Fox News that her primary concern lies not with proving Trump’s innocence or guilt but rather with how the jury perceives him. She expressed confidence that the evidence supports Trump’s innocence but remains apprehensive about potential biases influencing the outcome of the trial.

“The issue [is] we have politicized judges and blue juries coming in, and they’re supposed to be impartial, but you have a judge tweaking, reprimanding, putting down counsel on the other side, being harder on one side than the other, that affects the jury,” Habba said. “And that’s not fair. It’s not right.”

“Now, if President Trump is given a fair jury, a fair trial like anybody else in this country would be—because his name is Trump, he doesn’t—that’s where my concern is, not the facts. The facts are on our side,” Habba added.

Trump pleaded not guilty to 34 felony charges of falsifying business records in response to accusations that he orchestrated payment to adult film star Stormy Daniels through his former attorney Michael Cohen to cover up an alleged affair before the 2016 election.

The payment, recorded as “legal fees” in corporate documents, is alleged by prosecutors to be part of a scheme to influence the election outcome.

Trump maintains he paid Cohen $130,000 but denies any affair with Daniels.

Despite concerns about jury bias, Trump was unable to secure a change of trial location from Manhattan in 2023.

“Very unfair venue, with some areas that voted 1% Republican,” Trump posted on Truth Social last April ahead of his historic first court appearance. “This case should be moved to nearby Staten Island—would be a very fair and secure location for the trial.”

Chuck Rosenberg, a former U.S. attorney and senior FBI official, has dismissed Trump’s claim, stating that there is no historical precedent for changing the trial venue due to alleged jury prejudice.

“We tried a 9/11 conspirator in federal court in the Eastern District of Virginia—Alexandria, about three miles from the Pentagon—and we were able to assemble a fair jury,” Rosenberg told MSNBC.

“So, you’re not looking for a jury that’s never heard of Donald Trump, Stormy Daniels, or hush money payments. You’re not looking for a jury or jurors that have no opinions.

“You’re looking for jurors who can be fair, who can sit in the courtroom, listen to the evidence, and follow the instructions of the judge,” he added. “That’s all you’re looking for.”

  • I think hush money is the wrong way to describe this. It is much more like blackmail than hush money. He had to pay her to shut up, not because of an affair, but because she was blackmailing him. She knows that what she is saying is false and just to get blackmail money. She should be prosecuted for this travesty.

  • If I were Alina Habba, I would insist the judge declare a mistrial on this whole mess created and dominated by the Democrats. This entire trial is Democrat biased from the very beginning and we all know it!
