President Trump’s attorneys on Thursday requested that the Court hold Special Counsel Jack Smith in contempt for disregarding Judge Chutkan’s directive to suspend all proceedings in the case against Trump, dated January 6.
“President Donald J. Trump respectfully moves this Court for an order to show cause why prosecutors Jack Smith, Molly Gaston, and Thomas Windom (collectively, the “prosecutors”) should not be held in contempt for violating the Court’s order “stay[ing] any further proceedings that would move this case towards trial or impose additional burdens of litigation on Defendant.” Doc. 186 at 2 (the “Stay Order”).” Trump’s lawyer wrote in the order reviewed by The Gateway Pundit.
“The Stay Order is clear, straightforward, and unambiguous. All substantive proceedings in this Court are halted. Despite this clarity, the prosecutors began violating the Stay almost immediately. First, within five days of the Court entering the Stay Order, the prosecutors served thousands of pages of additional discovery, together with a purported draft exhibit list.
Through counsel, President Trump advised that he rejected the prosecutors’ unlawful productions, that their actions violated the Stay Order, and that he would seek relief if their malicious conduct continued.” Trump’s lawyer Todd Blanche wrote.
Last month, Judge Tanya Chutkan, who was appointed by Obama, suspended proceedings in the case against former President Trump relating to his involvement in the events of January 6th.
This action was taken following a dispute over the immunity argument presented by Trump’s attorneys.
In September, four counts had been brought against Trump for conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.
The defense maintained that he is immune from federal prosecution for any crimes committed while serving as president.
“In 234 years of American history, no president ever faced criminal prosecution for his official acts. Until 19 days ago, no court had ever addressed whether immunity from such prosecution exists,” Trump’s lawyers wrote in last month’s filing, according to CBS News. “To this day, no appellate court has addressed it. The question stands among the most complex, intricate, and momentous issues that this Court will be called on to decide.”
Jack Smith recently submitted a motion to the DC Circuit Court of Appeals, bypassing the appellate court and attempting to appeal directly to the US Supreme Court with his claims regarding President Trump’s immunity.
The US Supreme Court declined Smith’s request without comment. Smith will now have to wait for the DC Circuit Court of Appeals’ decision on his claim, as oral arguments are set for January 9th.
In accordance with Judge Chutkan’s order halting all proceedings pending a decision from the appellate court, Jack Smith has been barred from filing any further motions in this case until an outcome is reached.
Notwithstanding this restriction, last week Jack Smith filed a motion preventing President Trump from blaming provocateurs and undercover agents for the Capitol riot that occurred on January 6th.
“Through public statements, filings and argument in hearings before the court, the defense has attempted to inject into this case partisan political attacks and irrelevant and prejudicial issues that have no place in a jury trial,” Jack Smith’s 20-page filing said.
“Although the court can recognize these efforts for what they are and disregard them, the jury — if subjected to them — may not. The court should not permit the defendant to turn the courtroom into a forum in which he propagates irrelevant disinformation, and should reject his attempt to inject politics into this proceeding,” Smith wrote according to the court filing reviewed by The Gateway Pundit.
President Trump previously criticized Jack Smith for filing what he deemed an “illegal” motion, seemingly in an effort to restrict his First Amendment right.

In addition they act as though Trump has already been tried and found guilty of the crimes they have thrown at him. They need to be reminded to reread the Constitution, Bill of Rights, and th eMagna Carta, which specifically says that a person is innocent of any charge (accusation by a prosecutor) until proven guilty in a court of law by a jury of his peers. That has not happened. Until then, and right now it is suspended, no charge that they throw at him is worth two hoots and a holler in any legall setting. Desperation that he will not get a second term, Joe Biden, is directing every avenue to stop the title wave of American discontent from ejecting him.
