Watching a group of individuals burn an American flag is deeply upsetting, especially during recent anti-Israel protests.
This behavior was particularly prominent during Prime Minister Benjamin Netanyahu’s visit to the U.S. Many, including former President Donald Trump, advocate for severe legal consequences for flag burners.
Trump has consistently called for punishment and believes that a minimum one-year prison sentence is appropriate for this offense.
“Rarely have we seen anything like this,” Trump said. “And I think you should get a one-year jail sentence if you do anything to desecrate the American flag. Now people will say, ‘Oh, it’s unconstitutional.’ Those are stupid people. Those are stupid people that say that.”
Trump pointed out that world leaders, and especially America’s adversaries, are watching the same footage of Americans burning their own flag, and it projects weakness and chaos, which is bad news as far as national security is concerned.
“We have to work in Congress to get a one-year jail sentence,” the former president said.
“When they’re allowed to stomp on the flag and put lighter fluid on the flag and set it afire — when you’re allowed to do that — you get a one-year jail sentence, and you’ll never see it again,” he continued. “And all over the world, Putin and President Xi of China, all over the world they’re watching this. Kim Jong Un, he looks at us like we’re a bunch of babies. They see that, that wouldn’t happen in their countries. It’s impossible for that to happen in their countries. We look so bad to the world. That was a disgraceful display yesterday.”
The online community responded to Trump’s pledge to prosecute those who burn the flag, with a large majority expressing their support for the proposal.

It will be hard to get around the Supreme Court ruling burning the flag is free speech. That being said there can be a law against burning someone else’s flag such as vandalism, theft, destruction of private property etc. It can only be free speech if the flag belongs to the person doing the burning. So it is possible to jail and fine those who desecrate our flag.

We could simply pass a law that you cannot live in this country if you show that you hate it; you are a threat to the safety and security of the US. When they burn the flag (other than for legal reasons) or any other activity that shows they hate the US, prosecute them for hating this nation and when found guilty, exile them if they are a US citizen or deport them if they are not a US citizen — give them no more than 30 days to leave!

When the Supreme Court passed the burning of the American Flag as free speech, Texas, went around their decision and arrested individuals for setting a fire in public without a permit or near a fire hydrant.
