A Manhattan judge has rejected Mayor Eric Adams’s $700 million lawsuit against bus companies that transported over 33,000 illegal immigrants to New York City, stating that the case was “dubious at best.”
Filed in January, the lawsuit targeted 17 bus companies for allegedly violating state law by transporting people from Texas to New York City.
However, Manhattan Supreme Court Judge Mary Rosado deemed the lawsuit “unconstitutional,” citing the Interstate Commerce Clause.
Judge Rosado’s ruling on Monday stated that the city’s attempt to regulate the transportation of illegal immigrants across state lines violated constitutional provisions.
The lawsuit relied on a 19th-century “pauper’s statute,” which Rosado noted had already been declared unconstitutional by the U.S. Supreme Court over 80 years ago.
She specifically referenced a 1941 decision against a California law deemed “essentially identical.”
Mayor Adams had alleged that the bus companies neglected to cover the costs of caring for the illegal immigrants, resulting in expenditures of about $700 million over two years.
He stated, “These companies have violated state law by not paying for the cost of caring for these migrants, and that’s why we are suing.”
Lisa Zornberg, chief counsel to the mayor and City Hall, acknowledged the court’s decision but asserted that the 1817 statute on which the suit was based had not been definitively ruled unconstitutional.
Zornberg stressed that the city’s goal was to safeguard its social services system and residents.
Attorney Robert Hantman, representing the bus companies, commended Judge Rosado for her impartiality and legal adherence.
According to the city’s information, approximately 33,600 illegal immigrants have been bused to New York since April 2022.
The city also reported that over 200,000 migrants have arrived in total, with 64,000 still residing in city shelters as of July.
Before this crisis unfolded, Mayor Adams praised the Joe Biden-Kamala Harris government for halting Donald Trump’s border wall construction and declared that New York City would “always” be a sanctuary for migrants.
"We should protect our immigrants." Period.
Yes, New York City will remain a sanctuary city under an Adams administration. #EricOnNBC

During the Great Depression, California tried to guard its borders with other states to keep out migrants, for example from Oklahoma. The Attorney General from 1939-43 was Earl Warren, who later was the Chief Justice of the Supreme Court.
