Judge Cannon Indefinitely Postpones Classified Docs Trial After Special Counsel Admits to Evidence Tampering

Judge Aileen Cannon has indefinitely postponed Jack Smith’s trial involving classified documents against Trump. \

The trial was originally scheduled for May 20, 2024, but has been vacated.

This decision comes after Special Counsel Jack Smith admitted to tampering with evidence, leading Judge Cannon to postpone key deadlines in the case and set new pre-trial deadlines for managing discovery and disclosure matters.

It is uncertain when a new trial date will be set, as it may take several months.

“The Court also determines that finalization of a trial date at this juncture—before resolution of the myriad and interconnected pre-trial and CIPA issues remaining and forthcoming—would be imprudent and inconsistent with the Court’s duty to fully and fairly consider the various pending pre-trial motions before the Court, critical CIPA issues, and additional pretrial and trial preparations necessary to present this case to a jury. The Court therefore vacates the current May 20, 2024, trial date (and associated calendar call), to be reset by separate order following resolution of the matters before the Court, consistent with Defendants’ right to due process and the public’s interest in the fair and efficient administration of justice,” Cannon wrote in an order.

In a recent filing, Jack Smith acknowledged that the FBI had tampered with boxes containing “classified” documents seized from Trump’s property and could not confirm the original order or placement of the documents.

The FBI’s actions were revealed in a footnote in the motion, contradicting previous assurances by the DOJ to maintain the original state of the classified documents.

The DOJ misled the Court by falsely claiming that placeholders had been used for removed classified documents.

Additionally, in August 2022, the DOJ provided inaccurate information about the classification status of documents depicted in a viral photo.

“After the boxes were brought to WFO, the FBI created an index to correlate the documents with classification markings to codes (e.g., document “bb”) and labeled the classified cover sheets in the boxes with the codes for the seized documents. The FBI also generally replaced the handwritten sheets with classified cover sheets annotated with the index code, but regardless, any handwritten sheets that currently remain in the boxes do not represent additional classified documents—they were just not removed when the classified cover sheets with the index code were added. In many but not all instances, the FBI was able to determine which document with classification markings corresponded to a particular placeholder sheet.”
