A recently surfaced video depicts Maryland Representative Jamie Raskin participating in a panel discussion in 2024, where he suggested that Congress might need to overturn a presidential election victory by former President Donald Trump.

Raskin hinted at the potential for “civil war” if Congress did not take action. It remains uncertain whether Raskin was presenting a carefully considered strategy or simply engaging in a theoretical debate.

During his speech at the Politics and Prose bookstore in Washington, the Democrat forecasted that the U.S. Supreme Court would oppose the Democrats’ efforts to prevent Trump from appearing on the ballot in multiple states based on Section 3 of the Fourteenth Amendment.

Instead, Raskin contends that the Supreme Court would assert that Congress is responsible for making the decision.

In context, Section 3 of the Fourteenth Amendment was established after the Civil War to prohibit former Confederates from holding federal office.

Both extreme left and right-wing radicals have attempted to argue, using the ‘insurrection’ charge as a pretext, that Trump should be disqualified from running for president again and thus prevented from doing so.

The Supreme Court eventually ruled unanimously against these demands in March, establishing Congress, rather than the states, as responsible for enforcement.

According to Mr. Raskin’s predictions and analysis, this means that Congress would potentially need to take action if Trump were to win the election.

This prospect is deeply troubling, as it could potentially lead to severe civil unrest in the country.

Mr. Raskin played a prominent role in Trump’s second impeachment trial as one of the lead House impeachment managers.

From Constitution Annotated – Analysis and Interpretation of the U.S. Constitution:

“Ratified in the Civil War’s aftermath, Section 3 of the Fourteenth Amendment, which is sometimes referred to as the Insurrection Clause or Disqualification Clause, disqualifies any person from being a Senator, Representative, or elector of the President or Vice-President, or from holding any federal or state military or civil office, if that person has: (1) sworn to support the Constitution as a Member of Congress, officer of the United States, member of a State legislature, or state executive or judicial officer; and (2) subsequently engaged in insurrection or rebellion against the Constitution or given aid or comfort to its enemies. Section 3 further provides that Congress may remove the bar from an otherwise disqualifed person by a two-thirds vote in each House.

Section 3 has rarely been applied. In 1872, Congress removed the disqualification bar from all persons except Senators and Representatives of the Thirty-sixth and Thirty-seventh Congresses, officers in the judicial, military and naval service of the United States, heads of departments, and foreign ministers of the United States. And in 1898, Congress enacted broader legislation removing the remaining Section 3 disability incurred during the Civil War. On March 4, 2024, in its only decision specifically interpreting Section 3, the Supreme Court held unaminously in Trump v. Anderson that states cannot enforce Section 3 against federal officeholders or candidates. In so ruling, the Supreme Court reversed the decision of the Colorado Supreme Court that had held former President Donald J. Trump to be ineligible for the office of President under Section 3 on the grounds that he had engaged in insurrection and, therefore, could not be listed on the Colorado presidential primary ballot.”

    • Correct! Glad someone called this out. It started out as a peaceful demonstration by a group of concerned citizens and patriots, certainly not an insurrection by any stretch of the imagination.

Just in case people haven’t been watching, he has been the minority leader on every damn committee, and he has been twisting facts into his delusions quicker than a psycho can change personalities!
