With mail-in balloting comes many issues, but let’s be honest, the delay would probably help to elect Trump. Best of all, it would be Nancy Pelosi’s House that would vote for him to remain in the White House.

It all comes down to the 12th Amendment to the U.S. Constitution. If one or two states are unable to certify their elections by Dec 14th, it is up to the House to decide the election. Many of you may think that since the Democrats hold the majority, Biden would be a shoo-in. But that is not how they vote.

The delegations from each state for their choice for president. In other words, each state gets one vote, and to become president, you only need 26 votes. California has 53 seats in the House.  Wyoming has only one. But that one rep is equal to the 53 that California has.

Currently, the Republicans control 26 state delegations. The Democrats have 23 and Michigan is split 7-7. Justin Amash is an alleged Republican but he could vote for Biden.  That would deliver the state to Biden. But Trump still wins.

Is there a way stop from electing Trump? Yes, there is. They could stay away from the House and deny a quorum. But that would only last until January 3rd, when every member of Congress must get sworn in and vote for a Speaker of the House. If it comes to that, then the new House would vote on the presidency.

From the 12th Amendment:

The person having the greatest number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President.

But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice. 

And if the House of Representatives shall not choose a President whenever the right of choice shall devolve upon them, before the fourth day of March next following, then the Vice-President shall act as President, as in the case of the death or other constitutional disability of the President.

This would be interesting. It will also real the folly of mail-in voting. Let’s hope there is a clear winner and may that winner be Donald Trump. Joe Biden would spell disaster for the country.
